Fantora AI - Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fantora AI, including our website, applications, APIs, and related services (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You must be at least 18 years old and legally able to enter into a binding agreement to use the Services.

If you create an account, you are responsible for:

  • providing accurate and current information;
  • protecting your login credentials;
  • all activity that occurs under your account; and
  • promptly notifying us if you believe your account has been accessed without authorization.

2. Our Services

Fantora AI provides AI-assisted tools for creating and editing visual content. Features, limits, pricing, and availability may change over time. We may add, modify, suspend, or remove features when reasonably necessary for security, legal, operational, or product reasons.

3. Acceptable Use

You may use the Services only in compliance with applicable law and these Terms.

You must not use the Services to create, request, upload, share, store, or distribute content that:

  • is unlawful, fraudulent, defamatory, or infringes another person's rights;
  • contains malware, spam, phishing, or other harmful code or behavior;
  • violates privacy, publicity, intellectual property, or contractual rights;
  • is intended to harass, exploit, threaten, or abuse others;
  • depicts, promotes, or facilitates sexual exploitation, child sexual abuse material, incest, bestiality, rape, non-consensual sexual content, or graphic violence;
  • generates, requests, or promotes NSFW, pornographic, sexually explicit, nude, sexually suggestive, fetish, or adult-only content;
  • attempts to create deceptive or manipulative imagery of real people, including impersonation, non-consensual deepfakes, or identity manipulation;
  • attempts to bypass safety systems, moderation, rate limits, or technical restrictions.

4. Moderation and Enforcement

We may use automated and manual review systems to detect prohibited or unsafe use. We may block requests, remove content, suspend accounts, cancel access, or take other reasonable enforcement action if we believe a user, prompt, upload, or output violates these Terms, our policies, or applicable law.

5. Your Content

You retain any rights you have in content you lawfully submit to the Services. You represent and warrant that you have all rights, permissions, and lawful authority needed to submit your prompts, uploads, and other materials.

You grant Fantora AI a limited, non-exclusive license to host, process, transmit, store, and display your content as reasonably necessary to operate, secure, moderate, and improve the Services.

6. Intellectual Property

The Services, including our software, branding, design, text, graphics, and site content, are owned by Fantora AI or our licensors and are protected by applicable intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.

7. Payments, Plans, and Refunds

Paid plans, subscriptions, credits, and one-time purchases are subject to the pricing and billing terms shown at checkout.

  • Charges may renew automatically unless canceled before renewal.
  • You are responsible for applicable taxes, fees, and payment method accuracy.
  • Refunds are provided only when required by law or when expressly stated by us or our merchant of record.
  • We may suspend access to paid features for failed, reversed, disputed, or fraudulent payments.

8. Availability and Disclaimers

The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, perfect accuracy, or that outputs will be error-free, unique, lawful for your intended use, or fit for any specific purpose. You are responsible for reviewing and validating outputs before using or relying on them.

9. Limitation of Liability

To the maximum extent permitted by law, Fantora AI and its affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to the Services.

To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the Services will not exceed the amount you paid to Fantora AI for the Services during the 12 months before the event giving rise to the claim.

10. Suspension and Termination

We may suspend or terminate access to the Services at any time if reasonably necessary to protect the Services, other users, third parties, or our legal and commercial obligations, including where we believe you have violated these Terms or our policies.

You may stop using the Services at any time. Any provisions that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, limitations of liability, and dispute-related provisions.

11. Changes to These Terms

We may update these Terms from time to time. The updated version becomes effective when posted on this page, unless a different effective date is stated. Your continued use of the Services after the updated Terms take effect means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws that apply to the operator of Fantora AI, without limiting any mandatory consumer protection rights that may apply in your place of residence.
